Welcome to Auread. By downloading, installing, or using the Auread application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the App.
1. Acceptance of Terms
By accessing or using Auread, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the App.
2. Description of Service
Auread is a mobile application that provides reading and content management services. The App does not require you to create an account. By default, all data is stored locally on your device.
3. Circles Feature and iCloud Sync
The App offers an optional Circles feature that allows you to share selected content with people you choose. If you enable this feature:
- Content you choose to share with circles is stored in your personal iCloud account via Apple's CloudKit service
- You are responsible for maintaining the security of your Apple ID and iCloud account
- The Circles feature and your iCloud data are subject to Apple's terms and privacy policies
- We do not have access to your iCloud data; it is managed entirely by Apple
- You can disable the Circles feature at any time through the App settings
- You are responsible for managing who has access to your circles and what content you share
4. Acceptable Use
You agree to use the App only for lawful purposes. You may not:
- Upload, transmit, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Use the App to infringe upon intellectual property rights or copyrighted materials without proper authorization
- Attempt to gain unauthorized access to the App, other accounts, computer systems, or networks
- Use the App in any manner that could disable, overburden, or impair its functionality
- Reverse engineer, decompile, or disassemble any portion of the App
- Use automated systems to access the App without permission
5. Content Responsibility
Important: You are solely responsible for ensuring that you have the right to use any content with the App. You represent and warrant that you have obtained all necessary permissions and rights for any copyrighted or protected materials you use with the App.
6. Intellectual Property Rights
6.1 Our Rights
The App, including its design, features, functionality, and content (excluding User Content), is owned by Mark Webb and is protected by copyright, trademark, and other intellectual property laws.
6.2 Your Content
You retain all rights to the content you use with the App ("User Content"). Your User Content remains on your device and is not transmitted to our servers. If you use the Circles feature, content you choose to share is stored in your iCloud account and shared with circle members you authorize.
7. In-App Purchases and Subscriptions
The App may offer optional subscriptions and in-app purchases to unlock premium features. By purchasing a subscription, you agree to:
- Pay the fees specified for your chosen subscription at the time of purchase
- Automatic renewal of your subscription unless you cancel before the renewal date
- Subscription management through your Apple App Store account settings
- Pricing and availability may vary by region and are subject to change
All payments are processed through the Apple App Store and are subject to Apple's terms and refund policies. We do not have access to your payment information.
8. Cancellation and Refunds
You may cancel your subscription at any time through your Apple App Store account settings. Cancellation will take effect at the end of the current billing period. Refunds are handled according to Apple's refund policy. We do not offer refunds outside of Apple's policy.
9. Limitations and Warranty Disclaimer
The App:
- Is provided "as is" without warranties of accuracy or completeness
- May require an internet connection for certain features and may not function properly without connectivity
- May experience occasional interruptions or technical issues
10. Privacy and Data Security
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
The App uses third-party services to provide functionality and improve user experience, including:
- Firebase: For analytics and app performance monitoring
- Sentry: For error tracking and crash reporting
Each of these services has their own privacy policies, and your use of the App constitutes acceptance of their data practices as described in our Privacy Policy.
11. Disclaimers and Limitation of Liability
11.1 Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
11.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARK WEBB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the App
- Any unauthorized access to or use of your data
- Any errors or omissions in audio output or functionality
- Any interruption or cessation of the App
12. Indemnification
You agree to indemnify and hold harmless Mark Webb from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Your processing of content without proper rights or authorization
13. Changes to the App
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the App or by email. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
15. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will immediately cease.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of the United Kingdom.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mark Webb regarding the App and supersede all prior agreements and understandings.
